Assist Senior Lawyer, Prosecutions and Licensing, in planning, coordinating and undertaking the legal work in support of the Council’s functions relating to licensing, street markets, and criminal litigation. Have personal conduct of criminal cases including advocacy in connection with those cases.
Key responsibilities:
1. Undertake complex legal work and advocacy to the highest professional and client care standards.
2. Undertake court and tribunal work and in particular advocacy in the magistrate’s court ensuring that the Council’s case is put forcefully and effectively.
3. Maintain an up-to-date comprehensive knowledge of developments in the relevant areas of law undertaken by the post holder and advise the Senior Litigation Lawyer of any implications for the work of the Team.
4. Attend relevant committees, sub-committees, and other meetings to provide legal advice as required by the Senior Litigation Lawyer.
5. Act as a legal adviser to the Council’s Licensing committee, Licensing Sub-Committees, and Licensing Regulatory Committee to ensure that the service is responsive to client requirements and that work undertaken is reflective of best practice and the performance targets contained within Service Level Agreements.
6. Meet the chargeable hours target for the post and the agreed performance and quality standards as fixed by the Departmental Management Team.
7. Assist with training and development of staff, as directed.
8. Carry out duties in accordance with the Council’s Health and Safety Policy and relevant Health and Safety Regulations and to raise any concerns regarding health and safety matters with the Assistant Director of Law Commercial and Environment.
9. Assist the Senior Council Managers with the training of their staff in the legal implications of their work with particular reference to those areas for which the post holder is responsible.
10. Use and assist others to use information technology systems (including all corporate standards such as internet and e-mail) to carry out duties in the most efficient and effective manner to promote the development of new IT initiatives within the team.
Qualifications:
1. Qualified Solicitor or Barrister or Fellow of the Institute of Legal Executives holding a current practising certificate.
Knowledge:
1. Knowledge of current legislation and common law as they affect local government.
Experience:
1. Minimum of 12 months recent experience in a similar role or context and ideally within a public sector organisation.
2. Experience of giving advice on a range of legal topics.
3. Experience in using office and online applications on a personal computer, including legal reference texts.
4. Experience of advocacy personally and through Counsel, at a range of Courts and tribunals.
5. Experience of drafting legal documents, contracts, and preparing case files for litigation.
Skills & Abilities:
1. Excellent interpersonal, communication, persuasive and negotiating skills.
2. Strong IT skills including Microsoft packages or equivalent (e.g. G Suite).
3. Ability to analyse issues and provide clear advice to ensure that the County Council complies with its legal obligations whilst enabling solutions to problems to be found.
