Job Description:
The Pre-Litigation File Handler will be responsible for managing a caseload of Road Traffic Accident (RTA) personal injury claims at the pre-litigation stage. You will handle claims from initial instruction through to settlement, ensuring timely progression and delivering high-quality legal advice and support to clients.
Key Responsibilities:
* Case Management:
o Handle a caseload of pre-litigated RTA personal injury claims, ensuring efficient file management and timely resolution.
o Assess the merits of claims, gathering and reviewing relevant evidence including accident reports, medical records, and witness statements.
o Draft correspondence to clients, third parties, insurers, and medical professionals to progress claims.
* Client Communication:
o Maintain regular communication with clients to provide updates, offer advice, and manage expectations throughout the claims process.
o Handle client queries professionally and empathetically, ensuring they feel supported during their case.
* Pre-Litigation Process:
o Follow the RTA Claims Pre-Action Protocol, including drafting and issuing claims to insurers and third parties.
o Negotiate with insurers and third parties to reach a settlement before the need for litigation.
o Prepare cases for litigation if necessary, liaising with the litigation team when required.
* Compliance and Documentation:
o Ensure all work complies with relevant legal standards, internal procedures, and regulatory requirements, including those set by the Solicitors Regulation Authority (SRA).
o Keep accurate and detailed records of case progression, client interactions, and key documents on the case management system.
* Collaboration:
o Work closely with medical experts, engineers, and other legal professionals to build strong cases.
o Support and liaise with other team members to ensure smooth case progression and knowledge sharing.
Skills and Experience Required:
* Legal Experience:
o Proven experience handling personal injury claims, particularly RTA claims, in a pre-litigation context.
o Familiarity with the MOJ Portal process and RTA Pre-Action Protocol.
* Client-Focused:
o Excellent communication and interpersonal skills, with the ability to provide clear advice and support to clients.
o Demonstrated ability to manage client expectations and handle sensitive situations with professionalism.
* Case Management Skills:
o Strong organisational skills with the ability to manage multiple cases simultaneously.
o Attention to detail, ensuring accuracy in all aspects of case handling.
* IT Proficiency:
o Familiarity with case management systems and legal software for handling personal injury claims.
Qualifications:
* A legal qualification (LLB, CILEx, or equivalent) is desirable but not essential, provided the candidate has experience in pre-litigated personal injury claims.
* Prior experience handling Road Traffic Accident claims is highly preferred.
