JOB PURPOSE
We have an opportunity for a 1 + years PQE solicitor to join the Rural Business and Natural Capital team within the Real Estate practice area in Edinburgh.
The Rural Business sector is a vibrant and important part of the Scottish economy that is constantly changing and requires solicitors that can adapt to clients’ needs and expectations. The sector encompasses not only traditional land uses and activities but wide-ranging commercial interests requiring commercially minded and innovative advisers. We are recognised as an ambitious and market leading team acting for estates, farming and rural businesses, community bodies, forestry investors, lenders, funders, developers and public sector organisations across Scotland. We already have the largest dedicated team in this sector offering not only market leading legal but also first rate strategic and commercial advice.
The partner-led team that you will work in has a particular focus on forestry investment transactions, natural capital/carbon sequestration projects and advising landowner clients in relation to development projects that include the sale of land for residential or mixed-use development, grant of rights for infrastructure projects and option and lease rights for renewable energy projects. Some experience of rural property work and/or property development work will be useful but not essential. The role provides an opportunity to be part of the UK's market-leading forestry practice and to work closely with the partner and other colleagues in developing knowledge and skills within the nascent natural capital sector. The successful candidate will be a key part of the team and be provided with opportunities to develop legal and market knowledge within a supportive and collegiate environment and will enjoy working within a broad range of transactions affecting stakeholders in the rural sector.
CORE TASKS
* The role holder will have the opportunity to experience a wide range of work as follows:
* Purchase and sale of estates, farms, forestry and other rural land.
* Advising forest owners and forestry management businesses on all types of transaction affecting this asset type, including haul route agreements, windfarm option agreements, wayleaves and servitudes for electricity power lines.
* Acting for landowners in negotiating option agreements and promotion agreements for sale of land for residential and mixed-use developments.
* Providing advice to landowners on all types of rural development including residential, renewables, telecommunications and quarrying.
* Ongoing management legal advice to estates and rural businesses of all sizes including sales of bare land, sales of residential properties, and advising on issues such as land reform, trustee/partnership conveyancing, creation of title conditions.
* Advising on matters relating to agricultural holdings in both contentious and non-contentious situations, including the creation, termination and variation of agricultural tenancies, fixed equipment obligations and the pre-emptive right to buy.
* Advising on other types of lettings, such as commercial, residential, sportings and amenity leases.
* Title queries relating to complex Sasines titles including boundary disputes, access issues and title conditions.
* Purchase, sale, letting and management of sporting interests including salmon fishings, grouse moors and deer forests.
* Commercial and other contractual work related to land use (including overage agreements) and business structures in the sector.
PERSON SPECIFICATION

* Experience of property law and conveyancing, including title investigation and due diligence and drafting and negotiation of property contracts.
