Description
The team deals with pursuing subrogated recoveries on behalf of various insurer clients with a mixed portfolio of pre-litigation and litigated cases. The role of the litigator is to effectively manage a portfolio of Delegated (DA) & non-delegated authority (NDA) fast-track case litigation independently. In cases that are particularly complex or technical, the litigator will handle the matter pre-litigation.
The FT Litigator will assist with the coaching and supervision of less experienced colleagues. Some cases may involve a Personal Injury counterclaim, which will also be handled by the Fast-Track Litigator.
Key Accountabilities
* Manage a caseload of DA & NDA subrogated recovery files.
* Possess full knowledge of handling subrogated recovery claims from a claimant perspective through to conclusion via a court hearing.
The main aspects of the role involve:
* Reviewing and analyzing files throughout the life of the case, in accordance with client guidelines.
* Developing and maintaining client relationships, prioritizing the client in every decision.
* Formulating an initial strategy for approval by the Team Leader.
* Conducting legal research.
* Undertaking telephone negotiations with third-party insurers and solicitors.
* Liaising with the insured and insurers as necessary, guiding the claimant through the litigation process.
* Acting as a referral point for less experienced colleagues.
* Delivering agreed performance targets and quality standards.
* Maximizing costs claimed while ensuring they are not disproportionate.
* Keeping all files within ISO 9001 guidelines.
* Ensuring compliance with the SRA Standards & Regulations.
* Adhering to the Keoghs Values.
* Working in a target-driven environment.
The role requires an in-depth understanding of the court process, including:
* Drafting claim forms.
* Completing allocation questionnaires.
* Dealing with disclosure and exchange of evidence.
* Completing listing questionnaires.
* Completing pre-trial checklists.
* Instructing Counsel.
* Drafting CPR Part 18 questions.
* Drafting CPR Part 35 questions.
* Drafting counter schedules.
* Dealing with counterclaims.
* Drafting credit hire claims (where associated with a subrogated recovery).
Work Hours:
35 hours per week, Monday – Friday, 9 am – 5 pm with 1 unpaid hour for lunch.
