Role Profile Cladding financial redress Ensure where we have received funding from either the Building Safety Fund (for buildings > 18m) or the Cladding Safety Scheme (for buildings between 11-18m) where we are under an obligation, pursuant to the funding agreement(s), to pursue responsible third parties for financial redress. Work closely with our internal and external legal teams to review and consider contracts, settlement agreements and dispute resolution mechanism, ensuring that the correct dispute resolution procedure is being followed, whilst considering if arbitration and, legal processes. Prepare and submit regular reports to SLT in relation to First Tier Tribunal progressions, timescales, risks, forecasted likelihoods ensuring that applications and appointment letters/forms are approved and signed in accordance with procedures. Report on the submission and status of all of Grant claims, linked to FTT’s and ensuring that all legal documentation aligned to grant funding such as the execution of deeds and contracts are signed Lead on providing legal advice with regard to ‘without prejudice’ meetings with original cladding contractors with the successful outcome being the reaching of a settlement agreement. Ensure we follow procedures set down in the Pre-action Protocol for Construction and Engineering Disputes in relation to Riversides Principle Accountable Person (PAP) responsibilities. Work in consultation and support in house and external legal advisor to; Manage any Remediation Contribution Order made by the First-tier Tribunal (FtT), on the application of an interested party First-tier Tribunal, then of the Civil Courts (County Court and High Court including the Companies Court) Submit appeals to the BSR or the FtT. Apply to the FtT for a determination of any of the following (a) the person or persons who are the accountable persons for the building (b) the person who is the principal accountable person for the building (c) the part of the building for which any accountable person for the building is responsible. Appeal to the FtT compliance notice where the regulator TRG has contravened, be contravening or be likely to contravene a relevant requirement Building Safety Act Regulation Submit applications for all buildings in occupation to the regulator for a “Building Registration Certificate” for all in scope high risk buildings with the Building Safety Regulator on behalf of the Groups Licenced Duty Holder and Accountable person and ensure no buildings are occupied without the appropriate certification issued by the regulator. Ensure any mandatory, special or voluntary conditions attached to the Building Registration Certificate are complied with to the satisfaction of the Accountable Person and the Building Safety Regulator. Report to the regulator any structural and fire safety occurrences that could cause a significant risk Serve contravention notices on tenants who fail to comply with their obligations under the Building Safety Act. Ensure Riverside act upon any “compliance notice” or “urgent action notice” issued by the regulator requiring the group to take specified steps within a specified period. Support and respond to any request from a “special measures manager” appointed by the regulator Legal Access Procedures Develop, implement and monitor compliance with our risk policy milestones and support operatives gain access to customers' homes. Manage our access procedures and legal escalation to ensure access to customers' homes and ensure we are able to demonstrate all reasonable attempts have been made, and evidence held within our system to support legal cases. Work with external legal teams to produce witness statements for court applications. General Manage the performance and development of your Enforcement team providing expertise, coaching and other developmental support as required, ensuring a quality service is provided and under performance is dealt with appropriately. Work collaboratively with the leadership team to ensure effective delivery of the wider service. Ensure that all data protection requirements are met in accordance with the Group’s policy, procedures and statutory requirements. Person specification Knowledge, Skills and Experience Essential Qualifying law degree (LLB) or a non-law degree followed by a Common Professional Examination (CPE)/Graduate Diploma in Law (GDL) Clear understanding of dispute resolution mechanisms Experience holding without prejudice meetings and you should have excellent writing skills. Be able to produce clear, accurate and timely reports for senior management. Understanding of the Building Safety Act and shorthold tenancy agreements. Desirable Completion of Legal Practice Course (LPC) and member of Solicitors Regulation
