This is a full time post and the ideal candidate will:

* be able to manage a varied caseload (to include the preparation of Wills and Powers of Attorney, tax planning, estate administration and Court of Protection work);

* be STEP Qualified and have SFE membership – however, this is not essential and training is generally available for the right candidate.

Solicitor or Chartered Legal Executive – Contentious Trusts and Probate
An opening has arisen for an experienced and ambitious litigator specialising in contentious trust and probate.
You would be working within the dispute resolution department with responsibility for managing a caseload of predominantly contentious trusts and probate work and supervising the work of more junior members of the team within this field. There is significant scope for career progression within the role and to build and expand the firm’s contentious probate offering. You would be working closely with Ian Spencer, director and head of the dispute resolution to grow and develop this part of the department.
The dispute resolution department is based within the firm’s Kingsbridge office, although there is scope for the right applicant to be based in our Bristol, Totnes or Plymouth offices.
Applications are encouraged from Solicitors/Legal Executives of 3+ years PQE (or those with equivalent experience).
The ideal candidate will:
* Have experience of contentious trusts and probate caseload, including some or all of:
o Claims under the Inheritance (Provision for Family and Dependants) Act 1975;
o Will validity challenges concerning testamentary capacity, undue influence and fraudulent calumny;
o Mutual wills disputes;
o Claims over property concerning constructive / resulting trusts and proprietary estoppel;
o Disputes between beneficiaries and executors/trustees concerning the administration of wills and trusts;
o Claims brought under TOLATA 1996
* Have experience and knowledge of civil procedure within the High Court, particularly within the Chancery Division;
* Have enthusiasm and vision for the continued growth of the firm’s contentious trusts and probate offering.

Solicitor or Chartered Legal Executive – Dispute Resolution
In order to continue the growth of our Dispute Resolution department, we are looking to recruit a qualified lawyer to work across a varied caseload under the supervision of Ian Spencer, director and head of the dispute resolution department and other senior members of the dispute resolution department.
Initially you would be working on a wide variety of disputes including property litigation, contentious trusts and probate and commercial and construction disputes. Over time, there would be the opportunity to specialise in one or more of these areas.
The dispute resolution department is based within the firm’s Kingsbridge office and the successful candidate would be expected to work predominantly from this office with some flexibility to work remotely or from our other offices.
Applications are encouraged from Solicitors/Legal Executives of around 1 to 5 years PQE.
The ideal candidate will:
* Have knowledge and experience of litigation within the County Courts and / or the High Court;
* Have experience of some or all of the following areas:
o commercial and residential landlord and tenant disputes;
o disputes concerning easements/restrictive covenants including injunctive proceedings;
o boundary disputes;
o property damage claims;
o the Party Wall Act;
o contested leasehold renewals and enfranchisements;
o Contentious trusts and probate disputes;
o Construction disputes;
