Commercial Manager (Infrastructure – NEC Contracts)

Commercial Manager in the infrastructure sectorworking on NEC contracts plays a key role in overseeing financial, contractual, and risk management aspects of construction projects. The New Engineering Contract (NEC) is widely used for public and private sector works, and the commercial manager ensures that all project activities align with its provisions. Here’s a detailed job description:
Job Summary:
The Commercial Manager will be responsible for managing the commercial and financial aspects of infrastructure projects governed by NEC contracts. This role involves overseeing contract management, financial forecasting, risk mitigation, and cost control to ensure successful project delivery in compliance with NEC guidelines. The ideal candidate will have extensive experience in infrastructure projects, excellent negotiation skills, and a deep understanding of NEC contract forms.
Key Responsibilities:
1. Contract Management:
o Manage and administer NEC contracts (ECC, PSC, etc.) throughout the project lifecycle.
o Ensure compliance with contractual obligations, standards, and guidelines.
o Lead contract negotiations, including variations, claims, and final accounts.
2. Cost Control and Financial Management:
o Monitor project budgets, forecasts, and cost reports to ensure profitability.
o Implement effective cost control measures to mitigate financial risks.
o Lead financial reporting processes, including cash flow forecasting and variance analysis.
3. Risk Management:
o Identify, assess, and manage project risks, ensuring they are addressed within the NEC framework.
o Collaborate with project teams to establish risk mitigation strategies.
o Maintain accurate records of risk registers and ensure compliance with risk management procedures.
4. Stakeholder Management:
o Act as the main point of contact for commercial issues with clients, subcontractors, and suppliers.
o Build and maintain strong relationships with key project stakeholders.
o Collaborate with project teams to provide commercial insights and support decision-making.
5. Change and Claims Management:
o Administer change control processes and manage compensation events in line with NEC contracts.
o Prepare, assess, and negotiate claims and variations.
o Ensure timely and accurate submission of all commercial documentation related to claims.
6. Procurement and Supply Chain Management:
o Support procurement activities, including subcontractor selection and tender processes.
o Monitor subcontractor performance and ensure compliance with contract terms.
o Manage supply chain relationships to achieve best value for the project.
7. Reporting and Documentation:
o Prepare commercial reports for senior management, including cost-to-complete, budget updates, and risk assessments.
o Maintain accurate and up-to-date records of all commercial activities.
o Ensure proper documentation and communication of compensation events, early warnings, and contract notices.
8. Leadership and Team Collaboration:
o Lead and mentor junior commercial team members, providing guidance on contract management and NEC procedures.
o Work closely with project managers, engineers, and planners to ensure commercial objectives align with project goals.
o Promote a collaborative and transparent working culture within the project team.
Key Skills and Competencies:
* In-depth Knowledge of NEC Contracts: Strong understanding of NEC3/NEC4 contracts and their application in the infrastructure sector.
* Financial Acumen: Expertise in budget management, cost control, and financial forecasting.
* Negotiation and Influencing: Ability to lead negotiations on contractual and financial matters with clients, suppliers, and subcontractors.
* Risk Management: Proficient in identifying and mitigating commercial and contractual risks.
* Analytical Skills: Strong analytical abilities to assess project performance and develop solutions to commercial challenges.
* Leadership: Proven ability to lead teams and manage stakeholder relationships effectively.
* Communication: Excellent written and verbal communication skills, with an ability to articulate commercial strategies clearly.
* Attention to Detail: High level of accuracy in managing commercial documentation and reporting.
Qualifications and Experience:
* Education: Degree in Quantity Surveying, Construction Management, or a related field.
* Professional Certifications: MRICS, MCIOB, or similar professional qualification preferred.
* Experience: Minimum of 7-10 years of commercial management experience in infrastructure projects, with at least 3 years working on NEC contracts.
* Software Proficiency: Experience using cost management software and ERP systems.
