What the Job Involves This role engages you in diverse legal responsibilities concerning the council’s statutory duties to safeguard adults, rooted in the Care Act 2014. You will handle applications to the Court of Protection for cases around deprivations of liberty, hoarding, and various forms of abuse. In instances falling outside of the Mental Capacity Act 2005, your role extends to representing the council in the High Court for cases involving property removal and injunctions. You will defend judicial reviews related to social care provisions and Special Educational Needs, ensuring legal compliance and protection of the local authority’s reputation. Your remit includes offering expert advice to social care teams and managing disputes in ordinary residence and health/social care funding. You will also provide guidance in areas such as academy conversions, school governance, police collaboration, international safeguarding, and Human Rights obligations. Other responsibilities include advising on financial assessments and legal matters involving powers of attorney, alongside handling complaints to the Local Government Ombudsman. You will also represent the council in family court applications aimed at securing Forced Marriage Protection Orders.
