Main purpose ofrole:
Toprovide expert professional/technical legal advice and guidance tocolleagues managers Officers and Members to contribute to thedelivery of the Council s objectives and priorities and ensure thedelivery of an effective and efficient legal service to and for theCouncil.
KeyDuties:
Toprovide the efficient and costeffective delivery of legal servicesin the Adult Social Care and Education Team in relation to theCouncils statutory functions concerning Adult Social Services andEducation includingSEND.
Togive adequate and timely legal advice to the Council and itsvarious
departmentson all matters relating to Adult Social care law and Educationlaw.
Toundertake complex and routine legal cases including (but notexclusively) Court of Protection proceedings cases involving theHigh Court s inherent jurisdiction DOLS Mental Health Actapplications and ordinary residencedisputes.
Toundertake complex and routine legal cases advising on Education lawmatters including (but not exclusively) providing comprehensivelegal advice on school admissions exclusions special educationalneeds home to school transport prescribed alterations and change ofage range and the relatedGovernance
Tomanage time and responsibilities effectively without day to daysupervision
Toconduct proceedings public inquiries appeals and Judicial reviewsin the Courts and before Tribunals and to appear as advocate asappropriate;
Whereappropriate and in accordance with the Service s protocol toinstruct
Counseland/or externalsolicitors;
Toadvise maintained schools and academies in accordance with ServiceLevelAgreements;
Todraft and advise on reports for the Cabinet Cabinet Members CouncilCommittees and SubCommittees and to attend such committees andother meetings as the Assistant Director of Legal and Governancemay require;
Toensure proper records are digitally maintained on the casemanagement
systemrelating to all work undertaken including accurate time recordingof activitiesundertaken;
Toresearch legal questions arising from the work of the Council orits components or associated public bodies.To monitor changes in the law and practice as theyeffect the Team and implement changes when necessary. To inform theclient departments of changes in the law andpractice;
Tobring to the attention of the Principal Solicitor (or othermanagers within the Division as appropriate) any matters of whichthe Monitoring Officer should beaware;
Toassist in the training of trainee solicitors and to providetraining to Officers and Members asrequired;
Toparticipate in the provision of a limited out of hours telephoneservice for urgent mental healthqueries.
