The role We need a senior solicitor to join our growing national Estate, Trust & Will Disputes team in the Birmingham office. Although you will be based in one office, you will have the opportunity of working closely with the wider national Estate, Trust and Will Disputes team and will assist with delivering a service nationally across all seven of the firm's offices. In this role, you will act for a diverse and broad range of clients, including but not limited to private clients, trust companies, educational establishments, professional indemnity insurers, charities, business owners and high net worth individuals. In addition to running your own cases you will also be involved in the supervision of more junior members of the team. You will also be expected to carry out marketing and business development activities to support the continued growth of the team. The person You will be 5 PQE with significant experience in estate, trust and will disputes work gained in a City or large regional firm recognised for this practice area. Given the responsibilities of this role, it's likely that your background and experience will show that you are/have: Technically strong with relevant experience Excellent written English and drafting skills Good research skills, including an ability to use online information sources Strong interpersonal skills with the ability to build relationships with clients, potential clients and multipliers Negotiating skills Attention to detail Time and matter management skills Positive attitude and team player The activities The role will include dealing with a wide range of contentious issues relating to wills and trusts, including: Invalidity of wills on grounds of undue influence, improper execution, lack of testamentary capacity and want of knowledge and approval Proprietary estoppel claims Claims under the Inheritance (Provision for Family and Dependants) Act 1975 Removal of executors and trustees Breach of trust claims Applications pursuant to part 64 of the Civil Procedure Rules Rectification and construction of wills or trust documents Legacy disputes Professional negligence actions Claims pursuant to the Trusts of Land and Appointment of Trustees Act 1996 Court of Protection claims, including applications for statutory wills.
