Job Description
Ultra Precision Control Systems (PCS) are looking for a Commercial Manager to join PCS's Commercial function which is responsible for negotiating the terms and conditions in contracts and ensuring compliance with the terms and conditions and agreeing on any changes or amendments that may arise in the management of contracts made with customers, vendors, partners or employees.
Job Purpose:
* Implementation of the appropriate commercial / contractual arrangements for the delivery of the IPT’s projects and programmes, ensuring that such arrangements protect the Company’s commercial and financial interests.
* One of the Commercial function’s future senior representatives supporting Business IPTs.
* Ensure that all commercial aspects with respect to internal governance and contractual obligations are met and margins are maximised through effective commercial management and collaborative working with IPT structures.
* Lead/support preparation of material bids and to support their approval through the Ultra corporate hierarchy for submission to the customer.
* Lead contract and subcontract negotiations and the implementation of effective contract management during the project lifecycle for area of responsibility.
* Support implementation of commercial strategy and providing governance and policy support to IPT project teams.
* Leadership and line management and coaching, mentoring and support to a team.
Key Responsibilities
* Support development of effective commercial strategies to underpin the achievement IPT objectives.
* Ensure and maintain effective commercial governance in accordance with policies, procedures and processes.
* Effective implementation of commercial objectives followed by their effective management and achievement.
* Management of commercial aspects of Bids, including the drafting of terms and conditions and clearance through the Bid review process.
* Lead contract and subcontract and LTA negotiations ensuring the flow of prime terms and the implementation of effective contract management during project lifecycles for the IPT.
* Lead contract negotiations for non-strategic bids and subcontracts. Support strategic bids and contract negotiations.
* Identification and mitigation of commercial and contractual risk throughout the project lifecycle from bid to closure.
* Implementation of the appropriate commercial / contractual arrangements for the delivery of the IPT’s strategic projects and programmes, ensuring that such arrangements protect Ultra’s commercial and financial interests.
* Maintaining the strategically important Contracts Register and delivery of commercial analysis and reports and briefs along with inputs to CSRs and participate in senior level discussions.
* Effective resolution of any inter-company commercial issues and dependencies affecting the IPT projects and programmes.
* Support implementation and management of key business processes ensuring commercial integrity of activities through the bid review process.
* Support other commercial team members in the further development of overall commercial awareness across the enterprise.
* Work collaboratively with and support the IPT and other functions.
* Implement strategic decisions, in conjunction with Engineering, regarding the implementation of IP Management policies.
* Manage the dialogue with external audit agencies for government contracting price investigations.
* Support the development of strategies and lead/support effective resolution of commercial and contractual issues, claims (issued or received) and disputes including supporting through ADR procedures if required.
* Lead and contribute to continuous improvement through functional OKR ownership and through developing and support maintenance of commercial and contracting procedures and policies.
Requirements:
* Experienced in managing complex major contract negotiations and amendments with customers and suppliers.
* Have a detailed knowledge of Commercial Governance.
* Bachelor’s Degree in a relevant discipline including but not limited to business, economics and law.
* 7 years + aerospace and/or defence sector or other relevant experience.
* 10 years + major contracting or other relevant experience.
* In depth knowledge of the defence industry.
* Knowledge of Government defence contracting terms including DEFCONs, FARs and DFARS.
* Experience of export contracting.
* Understanding of other business functions and their respective roles and responsibilities.
* The role requires creative thinking and the ability to be a team player with the ability to influence people and develop others.
