The CIIOM legal function plays an important role in protecting HSBC’s reputation by helping to navigate the organisation through a complex legal and regulatory environment. The team has a diverse range of legal skills, jurisdictional experience, practice specialisms and is involved in high profile cross-jurisdictional work. The CIIOM legal team is also integrated into HSBC’s global legal team where international career progression is encouraged for those who desire that experience.
We are currently seeking an experienced lawyer to join HSBC CIIOM’s Legal team. The role will be based in Jersey and will primarily support HSBC CIIOM’s Trust and Fiduciary Services (TFS CI) business, a division of Global Private Banking.
Role purpose
1. Advising on a broad range of technical legal issues affecting the TFS CI business, including matters that may be complex, high-risk or have material impact.
2. Acting as a trusted adviser to the TFS CI business, by ensuring that commercially sensitive, pragmatic and strategic legal support and advice is provided in a cost-effective manner.
3. Assisting in the identification and oversight of actual and potential legal risks in the TFS CI business and advising on appropriate risk mitigation strategies.
4. Implement and review legal policies and procedures to ensure that the Group exposure to legal risks is managed appropriately within the TFS CI business and Legal’s role in the second line of defence can be executed.• Evaluating and responding to changes in legal and regulatory requirements as they arise, horizon scanning for potential emerging legal risks, and (where appropriate, working with other second line of defences functions) ensuring appropriate action is taken by the TFS CI business.
5. Supporting Senior Legal Counsel for TFS CI and the wider CIIOM and Global TFS Legal Teams, including assisting with larger strategic projects and general legal and operational support.
6. Ensure appropriate and timely escalation of significant issues, developments, and challenges in relation to TFS CI businesses
7. Manage the appointment and supervision of external legal counsel where required by the business for specialist legal advice.
8. Assist in managing the relationships with panel law firms/ external legal counsel and other appropriate external parties.
9. Develop supportive relationships with other specialist advisory functions, including regulatory compliance and tax.
Requirements
Required Knowledge & Qualifications:
10. Legally qualified, ideally with 2-5 years PQE or equivalent experience. Offshore experience in jurisdictions including Jersey will be beneficial.
11. Knowledge and experience of non-contentious trusts law is essential. International trust and trustee experience, as well as contentious trust experience is desirable.
12. Self-starter with the ability to learn quickly about the HSBC Group corporate structures, its business and personnel and develop a clear understanding of HSBC’s corporate culture.
13. Strong ability to deal with a number of internal and external stakeholders and to prioritise a demanding workload in terms of legal risk and commercial consideration.
14. Excellent written and verbal communication skills with the ability to generate clear and concise written and oral reports to management at a variety of levels.
15. Lateral thinking/problem solving and the ability to understand a range of complex issues and the impact of those issues from a legal, financial and reputational perspective to reach a solution.
16. Ability to keep up-to-date with key legal and regulatory developments impacting the TFS CI business and to advise the business accordingly to ensure ongoing compliance.
17. Willingness to act as a delegate for Senior Legal Counsel for TFS CI when required, including standing in at management meetings, and supervising legal matters.
