Job summary Mental Health Act Administrator - Band 5 Mon-Fri 8.00am-4.00pm. A unique opportunity has arisen for the recruitment of a dynamic and motivated individual, to join our Mental Health Compliance Team as a Mental Health Act Administrator at University Hospitals Birmingham. We are looking to recruit a full time experienced Mental Health Act Administrator to work across our organisation, with a primary base at one of our hospital sites, but with the ability to work across our four Hospital sites within the Organisation when required, therefore being a car driver would be essential. You will be working alongside members of the Mental Health Compliance Team and in collaboration with our established Mental Health Act Administration Team to ensure effective administrative procedures are implemented and ensure compliance with the statutory and legislative responsibilities within the Mental Health Act. Therefore, it is essential that the post holder has previous experience of the role or has a good, up to date, working knowledge and application of the Mental Health Act including case law. Knowledge of how this applies within the Acute Hospital would be advantageous, although not necessary. Main duties of the job The postholder will be responsible for managing the administration of the Mental Health Act in accordance with the Mental Health Act and its Code of Practice on behalf of University Hospitals Birmingham NHS Foundation Trust. This will include monitoring the management of the Mental Health Act processes in accordance with the legal framework, including receiving and scrutinising Mental Health Act Paperwork, organising and supporting Mental Health Act Review Tribunals and Hospital Lay Manager Hearings within the required timescales and legal requirements. The role will be responsible for supporting staff to be aware of their roles and responsibilities under the Mental Health Act and to deliver training to identified clinicians within the organisation on the Mental Health Act, as well as deliver bespoke training sessions as required on other aspects of the legal framework. The role will also ensure that support and advice is given to staff, patients, and nearest relatives on the Mental Health Act, including ensuring patients are informed of their rights in accordance with Section 132 of the Mental Health Act including their rights to appeal to the Tribunal and/or Hospital Lay Managers, their right to legal representation, and their right to access an Independent Mental Health Advocate. Working within the Mental Health Compliance team the post holder will also support in the management of mental health related incidents, synthesise data, aid with audit and research as required.
