Highly-regarded commercial offshore law firm in the Cayman Islands is looking to recruit a Financial Regulatory Solicitor or Barrister of 6 or more years’ PQE/Call. The Regulatory & Risk provides specialist financial regulatory and risk management advice on a global basis. Many of the team have gained their experience from having worked inside various national regulators such as the Cayman Islands Monetary Authority, the British Virgin Islands Financial Services Commission, the UK Financial Conduct Authority and the Central Bank of Ireland. They regularly advise a wide range of businesses in the banking, insurance and reinsurance, investment fund, administrator, fiduciary and investment management, advice, broker-dealer and arranger sectors. Matters they deal with include: • all regulatory applications and notifications, including new licences, variations or cancellations of existing licences • regulatory implications of mergers, acquisitions and reorganisations, including obtaining regulatory approval for changes of ownership or control • all day-to-day regulatory compliance matters • all required policies, procedures and compliance monitoring programmes • regulatory gap analysis and audits • preparing for regulatory inspections • anti-money laundering and counter-terrorist financing, including delegation, reliance on third parties and designation of compliance and money laundering reporting officers • international sanctions • anti-bribery and corruption • market abuse and insider dealing • corporate governance and directors' duties, fitness and propriety.
The successful candidate will work across multiple jurisdictions, undertaking regulatory cross-jurisdictional analysis and providing holistic solutions for the firm’s clients. You will also undertake both contentious and non-contentious Financial Regulatory matters. Contentious matters will include investigations and enforcement actions. You will also advise on financial crime prevention and sanctions-related issues. In view of this, a good understanding of the financial services industry overall is important (including banking, insurance, securities investment business, fintech and investment funds), with a good understanding of the global and onshore regulatory landscape. You will already be a qualified lawyer admitted in a commonwealth jurisdiction (such as England & Wales, Scotland, Ireland, Canada, Australia or New Zealand) or perhaps you are already working offshore and admitted to practice in the Cayman Islands.
