A new opportunity has arisen within the team, which presents an enviable career move. The person appointed will be focusing on a range of quality instructions and advising on:
1. Mental Capacity issues
2. Court of Protection (Health & Welfare)
3. Human Rights issues such as refusal, consent to treatment and care standards.
4. Inquests & Judicial Reviews
5. Coroners Court Proceedings
6. Ombudsman investigations
7. Public Law responsibilities and Regulatory obligations concerning provision of Health and Social Care
Experience in all areas is not essential, but experience in Court of Protection proceedings and working knowledge of relevant legislation (particularly Mental Capacity Act 2005, Liberty Protection Reforms and Mental Health Act 1983) is required.
The team is often instructed on complex, often high profile, cases requiring a team-based approach. It is anticipated that the nature of the role will appeal to an associate solicitor or CILEX with circa 0-3 years' specialist PQE. Applications welcome from NQs with COP or Inquest experience.
