Role Responsibilities
1. To receive cases that have fallen out of the Portal or are excluded from this process under the Civil Procedure Rules.
2. To manage a caseload of pre and post issue Fast Track, Intermediate and Multi Track claims to include OIC claims which require litigation.
3. To prepare and implement an “Initial Action Plan” on every EL and PL case.
4. To prepare an “Evidence Action Plan” in every case and implement the plan of action agreed by the Associate Director.
5. To fully investigate the injury claim and consider the question of rehabilitation.
6. To value PI claims competently & utilise JC guidelines/case law where appropriate.
7. To fully investigate and quantify special damages, ensuring that any subrogated losses are included and pursued, if relevant.
8. To establish and focus upon issues/facts in dispute in the context of liability and causation.
9. To adequately prepare and collate evidence in readiness for litigation.
10. To identify cases suitable for issue and to issue proceedings at the earliest opportunity.
11. To progress cases with the objective of maximising damages and cost recovery through issuing.
12. To comply with all rules, practice directions or Court Orders and where this is not possible, to apply to the Court promptly so as to minimise the sanctions imposed for non-compliance.
13. To regularly review the prospects of success and report back to the Associate Director if this falls below 51%.
14. To keep clients regularly updated as to the progress of the case and provide them with the highest level of customer service.
15. To properly advise the client on settlement offers and take instructions promptly.
16. To ensure there is appropriate funding in place to cover the adverse costs of litigation.
17. To minimise any adverse costs orders and the firm’s exposure to write offs generally.
18. To manage task lists and organise working day/week and ensure this is up to date at all times.
19. To draft Pleadings, Application Notices, Disclosure Lists, Witness Statements, Part 35 Questions, Schedules of Loss, Brief to Counsel, Trial Bundle Index and Case Summary.
20. To make effective use of Part 36.
21. To attend Court (personally or by way of telephone) and perform advocacy for Case Management Conferences, Application Hearings.
22. To complete internal forms for Defence EAP’s and Witness Statement EAP’s.
23. To seek appropriate authority from the Associate Director and/or Directors before taking steps on the case, requisite to the individuals authority levels.
24. Be responsible for achieving set individual and assisting the achievement of team targets.
25. Complete and compile data utilising the Case Management IT system.
26. To confidently use Management Information to manage the caseload and individual performance against targets.
27. To appropriately involve the Associate Director and/or Directors where input on technical matters and operational issues is warranted.
28. To follow the training/guidance provided by the Associate Director and/or Directors.
29. To comply with all policies and procedures at all times.
30. To comply with supplier SLAs.
What We Need From You
1. Minimum 3 years’ experience in dealing with Personal injury claims preferred.
2. Experience of handling Fast Track PI cases from inception through to the issue of proceedings, settlement and Trial.
3. Experience of delivering against agreed targets.
4. Experience of working in a legal, insurance or professional environment.
5. Strong understanding of current PI Procedures.
6. Ability to collect and assess evidence, determine prospects, provide appropriate advice to clients and progress claims efficiently.
7. Excellent telephone manner / verbal communication skills.
8. Strong negotiation skills.
9. Ability to write clearly, correctly and concisely.
10. Good comprehension skills relating to the understanding of a range of documents related to a case.
11. Competent use of MS Word and Excel required as well as general computer skills.
12. Proven competency in the efficient use of the Proclaim CMS.
13. Solicitor, ILEX or experienced Litigation Fee Earner.
14. Excellent knowledge of civil procedure and tactics.
15. Ability to interpret and make effective use of Management Information.
16. Ability to prioritise workload, work to deadlines and take decisions commensurate to the role.
17. A highly structured and organised approach to handling a large volume of cases.
18. Ability to work on own initiative and as part of a team.
19. An ability to work with a considerable amount of detailed information.
20. A positive attitude and can-do approach.
21. Self-motivation and a desire to learn, progress and develop.
