Gateley Vinden are a leading multi-disciplinary consultancy (Quantity Surveying, Dispute Resolution, Expert Witness, Forensic Planning & Delay Analysis, Legal, Building Surveying ) offering services to Clients (Employers, Funders, Main Contractors and Sub-Contractors) throughout the construction industry.
Gateley Vinden are looking to recruit a Senior Consultant to advise the Surety market. The role involves working closely with the Gateley Legal Surety Team, with a focus on managing the claims process and stepping into the shoes of insolvent contractors or subcontractors to settle accounts.
This is a fantastic opportunity for a seasoned construction professional looking to transition into the Surety market and gain experience in managing claims, resolving disputes, and providing expert guidance to Surety clients. This role is also suited to an individual with experience as a senior commercial manager in the construction industry, with an interest in legal issues and contract conditions.
This is a primarily Manchester-based role with periodic site visits across the UK. The Senior Consultant is involved reviewing contract documents, conducting site assessments, managing disputes, and interacting with various stakeholders, including solicitors, employers, and insolvency practitioners
You will be responsible for:
* Examining contract bonds and associated documents to ensure compliance and assess contractor obligations
* Conduct site visits to ascertain work completed to date and evaluate progress.
* Advise on strategies for mitigating loss and assist in the procurement of completion contracts.
* Work closely with insolvency practitioners to manage the fallout from contractor insolvency.
* Provide advice to employers regarding their contractual entitlements following the termination of employment contracts.
* Review damages claims against the Surety, negotiate settlements, and draft settlement agreements.
* Draft comprehensive written reports for Surety clients with detailed recommendations on claims management and settlements.
* Liaise with and instruct solicitors as required, ensuring smooth communication and cooperation between all parties involved.
* Work with the Gateley Legal Surety team on the recovery of losses under counter indemnity documents
The Person
Candidates will be able to demonstrate the following attributes:
* Ideally a MSc in Construction Law or a fellow of Cira
* 10–15 years of experience as a commercial manager or consultant within the construction industry, ideally with exposure to various contract forms (e.g., NEC, JCT, FIDIC).
* Strong report-writing skills with the ability to present findings and recommendations clearly and concisely.
* Excellent communication skills, with the ability to quickly build relationships with claimants, clients, and legal teams.
* Ability to conduct detailed desktop reviews of contractor obligations and financial entitlements.
* Commercial approach to investigating and settling claims.
* Strong negotiation skills for claim settlements.
* Keen interest in legal matters and familiarity with contract conditions and dispute resolution.
* Ability to work independently and manage multiple cases simultaneously.
