The role will primarily focus on CAPEX (Capital Expenditure) matters with responsibilities spanning all aspects of construction law (primarily non-contentious). The role holder will split their time between CAPEX work and providing support to the rest of the team on broader commercial matters including procurement categories across the direct and indirect category. Provide legal guidance and support for CAPEX projects, overseeing all aspects of construction law while ensuring adherence to relevant laws, regulations, and company policies:
1. Non-contentious: Draft and negotiate standard form contracts (such as MF1, NEC3) and bespoke construction agreements, including collateral warranties, bonds, and guarantees.
2. Contentious: Advise on disputes and lead negotiations for settlements. Manage relationships with external counsel as required.
3. Commercial Agreements: Draft, review, and negotiate a wide range of commercial contracts, including supply, service, and framework agreements. Support procurement teams on vendor contracts, tender processes, and supplier disputes. Address commercial issues related to intellectual property, data protection, and regional compliance, while identifying and managing legal risks with practical solutions.
4. Training and support: Assist in delivering legal and compliance training to procurement teams. Contribute to the development and implementation of precedent agreements, templates, and guidelines, focusing on continuous improvement to maintain their relevance and effectiveness.
5. Qualified Solicitor with 3-4 years PQE (alternatively significant time spent as a paralegal may be counted towards PQE or equivalent), holding a current UK practising certificate.
6. Extensive experience in construction contracts (MF1, NEC3, JCT) and commercial contracts.
7. Strong commercial acumen with excellent communication and advocacy skills.
8. Demonstrated ability to manage demanding clients, meet tight deadlines, and thrive in fast-paced environments with creativity and effective problem-solving skills.
9. The ability to operate and influence effectively across different stakeholder levels, demonstrating flexibility of style and communication skills.
