My client is a large national corporation whose clients include Local authorities and HMRC. They provide white-labelled enforcement services for example council tax payment and parking enforcement.
This role will be responsible to the Commercial Counsel for the provision of legal advice and undertaking a varied caseload relevant to the grade in the areas of work covered by the team.
Particular focus will be given on reviewing and assessing the risks of client and supplier contracts including (but not limited to) NDAs, outsourced public service agreements, framework agreements, master service agreements, statements of work, service level agreements, IT/IP agreements within bids processes, tenders, procurement.
Core Duties and Responsibilities
1. To review clients and suppliers contracts and support the Commercial Counsel in meeting relevant deadlines;
2. To deal with an extensive workload requiring legal drafting, procedure and advice on the range of issues arising in the team including dealing with matters of a sensitive nature and ensuring confidentiality at all times;
3. To act as lawyer primarily responsible for non-complex legal matters arising from the Marston Group and external clients included with the portfolio of work covered by the team;
4. To assist in the preparation of contracts variation, termination letters, contracts drafting and external contracts review relevant to the caseload undertaken and to provide legal advice, comments and guidance as required for the business on the relevant terms ensuring that the Marston Group goals and objectives are achieved;
5. To assist the Commercial Counsel in legal process reviews to ensure efficient and effective working practices;
6. To ensure that all work is appropriately prioritised to meet deadlines and targets and comply with timetables and re-prioritise work as required to deal with urgent matters in the team;
7. Develop and maintain positive relationships with colleagues, stakeholders and communities to ensure the Marston Group strategic priorities are effectively implemented;
8. Support organisational change and learning, following and implementing appropriate systems of self-development, communication and engagement, quality measures, monitoring and review in delivering the functions of the role;
9. To liaise with senior stakeholders and officers as necessary in respect of the caseload of matters undertaken seeking appropriate instructions and providing expert professional advice;
10. To attend meetings with clients and suppliers senior officers when required.
Areas where legal advice will be required will include the following:
* the Procurement and bids process;
* contracting (as supplier and client) reviewing, contract drafting;
* commercial legal risk review of all contracts;
* any other matters as directed by the Commercial Counsel or the Group Head of Legal.
Training Requirements
* Maintain Continuing Professional Development, including knowledge of all relevant Legislation, Regulation, and Case law, including (but not limited to) the Companies Act 2006, the DPA 2018, and the SRA regulatory framework generally.
Person Specification
* Experience in advice, interpreting legal issues, preparing written advice and conducting legal casework relevant to the post;
* Ability to work unsupervised on a varied and extensive caseload of routine matters and to work effectively under pressure prioritising tasks;
* The ability to draft documents in a logical, accurate and timely manner;
* The ability to prioritise work clearly to meet demanding workloads and to deal with different types of work from a variety of sources;
* IT literate, able to understand and operate basic work packages including Outlook.
Qualifications: Desirable
Qualified UK Solicitor or Barrister NQ-2 PQE.
Knowledge and Skills: Essential
* Experience of working in an “in-house” Commercial Legal team;
* Experience of at least two of: contract and procurement law, Bids, Tenders, commercial law, data protection;
* Experience of successful workforce development and managing high performing teams to agreed targets and service standards;
* Knowledge of relevant legislation, standards national policies and legal procedures that apply to the area of work undertaken by the team.

* To ensure that you adhere to the requirements of the Data Protection Act in respect of confidentiality, security and disclosure of personal data;
* To ensure that you comply with Marston Information Security Management (ISMS) policies and procedures;
* To uphold Group Information Security Management (ISMS) policies and report any suspected incidents or any observed weaknesses with the companies Information Security Management System to your Line Manager or the Information Security Manager immediately;
* To ensure that you understand your responsibilities to reduce the risk of theft, fraud or misuse of facilities;
* To ensure that you are aware of information security threats, your responsibilities and are equipped to support ISMS in the course of their normal work to reduce the risk of human error;
* To be responsible for evaluating and reviewing the work carried out in your areas of responsibility including all related security responsibilities.

General: The post holder is expected to carry out any other duties reasonably expected with the general level of the post. The post holder will be subject to clearance through the Disclosure and Barring Service and a County Court Judgment check. In addition, the post holder is expected to keep the Company updated if their personal circumstances change.
