Key Responsibilities: Regulatory Compliance and Oversight: Ensure the company adheres to all applicable FCA regulations, including those specific to the CFD industry such as the FCA’s product intervention measures on CFD offerings (e.g., leverage limits, risk warnings, and margin close-out rules). Maintain comprehensive knowledge of the FCA Handbook, specifically sections that impact CFD providers such as SYSC, COBS, and MAR (Market Abuse Regulation). Monitor, review, and update the firm’s practices and procedures to align with evolving FCA guidelines and industry best practices, particularly in relation to the marketing and distribution of CFDs. CFD Product Compliance: Oversee compliance with the FCA’s restrictions and regulations around offering CFDs to retail and professional clients, including leverage caps and the requirement for risk warnings. Monitor client onboarding processes to ensure compliance with the FCA’s appropriateness assessment for retail clients and classification of professional clients. Ensure that promotional materials and client communication are compliant with the FCA’s financial promotion rules and present accurate, fair, and not misleading information. Anti-Money Laundering (AML) & Financial Crime: Ensure the firm’s full compliance with Anti-Money Laundering (AML) regulations and counter-terrorist financing (CTF) requirements. Act as the Money Laundering Reporting Officer (MLRO) where necessary, overseeing the firm’s Know Your Customer (KYC) and Customer Due Diligence (CDD) processes, particularly with regards to high-risk clients. Identify, assess, and manage financial crime risks related to CFD trading activities and ensure the firm adheres to the FCA’s anti-market abuse requirements. Monitoring and Reporting: Develop and implement a robust compliance monitoring program to oversee trading activities, ensuring they align with FCA rules, especially around conduct risk, market abuse, and client fund protection. Prepare and submit FCA reports, including but not limited to annual compliance reports, notifications of breaches, and any ad-hoc regulatory filings. Manage and report any suspicious activities, compliance breaches, or significant risk exposures to senior management and the FCA as required. Internal Policies and Procedures: Develop and maintain internal policies and procedures relating to regulatory compliance, conduct risk, financial crime, and other regulatory obligations, ensuring they align with FCA expectations. Ensure policies are communicated and understood across all departments, particularly those involving sales, trading, and client-facing teams. Perform regular compliance audits and risk assessments to identify any gaps in the current processes and implement corrective measures. Training and Development: Design and deliver regular compliance training programs for employees, focusing on FCA regulations, internal compliance policies, and CFD-specific compliance risks. Ensure that staff are fully aware of their regulatory obligations, including AML, market conduct, client fund handling, and any other relevant regulatory requirements. Keep abreast of any changes in regulatory requirements affecting the CFD industry and ensure the firm’s teams are updated accordingly. Relationship Management with FCA and Other Regulators: Act as the primary point of contact with the FCA and other relevant regulatory bodies. Manage regulatory inspections, audits, and reviews, ensuring the firm remains compliant with all regulatory obligations and addresses any concerns raised by regulators. Respond to FCA inquiries and requests for information in a timely and comprehensive manner. Risk Management: Monitor and assess risks associated with the firm’s CFD business activities, ensuring controls are in place to mitigate those risks. Work closely with the Risk Management team to ensure the firm’s risk framework is aligned with FCA expectations, especially regarding market conduct, liquidity risks, and client exposure. Key Skills and Qualifications: Education: Bachelor’s degree in law, finance, economics, or a related field. Professional certifications in compliance (e.g., ICA, CISI) are preferred. Experience: Extensive experience in compliance roles within the financial services sector, at least 6 years experience on the CFD industry and familiarity with the FCA’s regulatory framework. Regulatory Knowledge: In-depth knowledge of FCA regulations, particularly those relating to CFDs, financial promotions, appropriateness tests, market conduct, and AML. Skills: Strong analytical and problem-solving skills, with the ability to interpret complex regulatory requirements and implement practical solutions. Excellent communication and interpersonal skills, capable of effectively engaging with senior management, regulators, and employees. High attention to detail, with the ability to manage multiple tasks and prioritize in a fast-paced environment. Strong organizational skills, with experience in managing regulatory filings and reporting processes.
