Position Summary:

The Municipal Prosecutor is responsible for conducting Part I, Part II, and Part III prosecutions, appeals and early resolution meetings in the Ontario Court of Justice for offences under provincial statutes, select federal statutes, municipal by-laws, and matters delegated by the Attorney General. Reporting to the Executive Director of Legal and Corporate Services, the Municipal Prosecutor works collaboratively with the Court Services Division and in accordance with the Memorandum of Understanding (MOU) Prosecutorial Standards.
Primary Responsibilities:
1. Work collaboratively with organizational leaders to address challenges, and identify and implement new opportunities and initiatives.
2. Supervise Prosecution staff, including the organization, coordination, assignment and monitoring of work, recruitment and selection, training, orientation, and performance appraisals of staff to ensure effective and quality service delivery.
3. Assist the Executive Director of Legal and Corporate Services and the Manager of Court Services in developing policies, procedures, and systems to conduct prosecutions.
4. Mentor and support internal staff development to achieve division goals, promote professional growth, and ensure sustainability and succession planning by identifying training requirements and coordinating professional development opportunities for Prosecution staff.
5. Contribute to division planning, goals and objectives within the County budget.
6. Conduct prosecutions in accordance with the Ministry of Attorney General standards, Inter-municipal Agreement, by-laws and other related legislation, policies, practices and procedures under Provincial Statutes, including Part I, Part II and Part III matters under the Provincial Offences Act (and other statutes), select Federal Statutes and Municipal By-laws in Provincial Courts, and any other matters delegated by the Attorney General.
7. Conduct motions, trials and other court proceedings; tender evidence, examine and cross-examine witnesses, present oral and written arguments; summarize evidence and make submissions regarding recommendation for judgment and sentencing.
8. Conduct early resolution meetings, pre-trials and first-attendance meetings, discussing charges with defendants or legal representatives, negotiating settlements as required, making determinations to proceed with charge, withdrawing or reducing the charge, and attending before the Justice of the Peace for final decision.
9. Review and prepare witness statements; interview and prepare witnesses.
10. Conduct legal research and prepare specific case law responses; prepare and serve associated court documents, including Evidence Act Notices, disclosure materials, Notices of Motions, Affidavits, written submissions, and Factums.
11. Conduct appeals in the Ontario Court of Justice.
12. Perform related administrative functions including providing disclosure, drafting correspondence, reviewing and processing files, and managing trial lists.
13. Develop policy and make recommendations related to the needs of the Prosecution Division, while working with various enforcement agencies, defendants, various representatives, members of the judiciary and the public, and other municipal Court Services Divisions to support initiatives which include the implementation of strategies, collection of background information, and consideration of policy and legislative impact.
14. Maintain current knowledge of developments in all applicable legislation and the common law, case law developments, County policies and procedures, etc. ensuring that these are implemented.
15. Liaise with County Council, local Councils, municipal, government officials, and court stakeholders, including the judiciary, legal professionals, enforcement agencies, provincial ministries, and Crown Attorney.
16. Consult with other municipal prosecutors and professional colleagues for information exchange pertaining to Province Offences matters and best practices for service delivery.
17. Perform other assigned functions/duties as required.
18. Leaders and Supervisors are responsible under the Occupational Health and Safety Act to take every precaution reasonable in the circumstances for the protection of workers. This includes ensuring adherence to the Occupational Health and Safety Act and County of Perth policies and procedures. Leaders and Supervisors are accountable for providing job-specific training including awareness of job hazards and instructions on methods of control and for monitoring workers for compliance.
Qualifications:
1. University degree or college diploma in Law, Paralegal, or related field of study.
2. Class L1 licence to practise law or a class P1 licence to provide legal services issued by the Law Society of Ontario.
3. Licensed member in good standing with the Law Society of Ontario.
4. Three to five years experience in a professional legal environment, preferably in prosecuting Provincial Offences matters and/or as a Paralegal.
5. Experience appearing before Provincial Offences courts or similar courts/tribunals.
6. Thorough knowledge of the Provincial Offences Act, Highway Traffic Act, Contraventions Act, Charter of Rights and Freedoms and related statutes and regulations, and the rules of evidence.
7. Demonstrated ability to work independently in a quick-paced environment with minimal supervision.
8. Ability to communicate effectively with a variety of stakeholders, representing the County on official business.
9. Proficient in Microsoft Office Suite.
10. Experience with CAMS and ICON technologies.
11. Excellent organizational, leadership and communications skills.
12. Organizational skills to manage court lists and meet statutory and administrative deadlines and to handle a large daily caseload of various provincial and by-law offences.
13. Ability to handle multiple duties effectively.
Shift: Monday to Friday, 8:30 am to 4:30 pm (35 hours per week)
Salary Range: $82,609.80-$96,623.8 (based on Perth County’s 2024 salary grid).
