Position Summary:
The Trusts and Estates associate/senior associate will play a key role in supporting and advancing the firm’s private client practice. This position involves working closely with senior attorneys and partners on all phases of trust and estate matters such as disputes, including contested probate matters, and complex family and trust litigation. The ideal candidate will have a strong background in litigation with an emphasis on trusts and estates, probate litigation, or related areas.
Key Responsibilities:
* Case Management: Manage all aspects of trust and estate litigation matters, including drafting pleadings, preparing discovery, taking and defending depositions, conducting legal research, and preparing for and assisting in trials.
* Client Interaction: Serve as a primary point of contact for clients; work directly with clients to gather information, advise on litigation strategy, and communicate case progress.
* Legal Research & Writing: Draft legal briefs, motions, and other litigation-related documents. Conduct detailed legal research and analysis to develop case strategy.
* Court Appearances: Represent clients in court proceedings including motions, hearings, trials, and appeals.
* Discovery & Depositions: Draft discovery requests, conduct depositions, and review documents produced in discovery. Handle preparation for witness examination and expert witness consultations.
* Collaboration: Work collaboratively with senior attorneys and partners to devise effective strategies for litigation matters. Support firm attorneys in mediation and settlement negotiations as needed.
Qualifications:
* Qualification: Admitted to a commonwealth jurisdiction
* Experience: 3-10 years of litigation experience, preferably with a focus on trusts and estates or fiduciary litigation. Strong candidates with general litigation backgrounds and a genuine interest in estate disputes will be considered.
Skills:
* Litigation Acumen: Demonstrated success in managing multiple cases, performing legal research, and drafting and arguing motions.
* Client Service: Strong interpersonal and communication skills; experience working with clients in sensitive, high-stakes situations.
* Organizational Skills: Ability to prioritize tasks, manage time effectively, and meet deadlines in a fast-paced environment.
* Analytical Skills: Keen attention to detail, analytical thinking, and a proactive approach to solving complex legal issues.
* Technical Skills: Proficiency with case management software, legal research platforms, and document management systems.
Preferred Qualifications:
* Advanced Knowledge of Trusts & Estates Law: Familiarity with estate planning instruments, probate procedures, and fiduciary duties.
* Trial Experience: Hands-on experience taking cases through trial or supporting senior attorneys in trial preparations.
* Mediation and Negotiation Experience: Strong foundation in alternative dispute resolution techniques as they pertain to family and estate matters.
