We are seeking an experienced Managing QS/Commercial Manager with a strong background in managing NEC contracts to oversee commercial aspects of our projects, including management of the contract with the main client, and management of our key sub-contractor accounts. The ideal candidate will have extensive knowledge of NEC contract management, negotiation, and dispute resolution while ensuring compliance with regulatory and company policies.
The Commercial Manager will report to the Commercial Director.
Key accountabilities/scope of work:
* Manage and oversee the administration of NEC contracts with our key clients and sub-contractors.
* Manage contractual variations and events management processes, ensuring that all information and communication with the client is aligned with the contractual expectations (i.e. early warning notices and/or compensation events).
* Collaborate with project teams to resolve commercial issues and support decision-making processes.
* Provide guidance on contract interpretation and application, ensuring compliance with NEC principles.
* Review Subcontractor monthly applications for payment, assessing progress of works, valuing work completed and producing payment certificates.
* Work with finance teams to submit monthly applications for payment to the main client which identifies advance payments, progress of works, compensation events & escalation formulae etc.
* Identify risks and opportunities within contracts and advise stakeholders accordingly.
* Liaise with legal advisors to ensure that contracts meet legal requirements.
* Prepare and present commercial reports to senior management.
* Foster strong working relationships with clients, suppliers, and subcontractors.
* Monitor project financial performance, including budgets, forecasts, and reporting.

* Demonstrate knowledge of technical/professional principles, methods and processes, including, collection, analysis and interpretation of data and the reporting of results.
* Evaluate potential consequences of different courses of action, anticipating future developments and impact.
* Present findings and recommend evidence-based solutions.
* Make decisions reflecting best practice and technical/professional theories and standards.
* When working on projects, weigh advantages of choices and take decisions by prioritising the activities to be implemented, evaluating the use of resources and assessing risks.
* Take responsibility for the impact of their decisions and show willingness to reconsider decisions taken.
Key experience, qualifications and skills:
* Proficient in NEC 3 understanding and application.
* Membership in a relevant professional body (e.g., RICS, CIPS) is desirable.
* Experience in construction, infrastructure, or engineering sectors, preferably but not essentially within the construction materials sector.
* Bachelor’s degree in Business Administration, Finance, Quantity Surveying, or a related field; a master’s degree is a plus.
* Extensive knowledge of NEC suite of contracts (NEC3, NEC4) and their application in construction or engineering projects.
* Strong negotiation and communication skills, with the ability to influence and manage stakeholders.
* Excellent analytical and problem-solving abilities.
* Proficiency in contract management software and Microsoft Office Suite.
