People Group are currently looking for a Compliance Manager to work for a leading service provider in the water and wastewater infrastructure sectors in the UK.
Responsibilities:
* With the support of the business, conduct a thorough analysis to identify Personal Service Companies (PSC’s) and Sole Traders within the supply chain, both directly and through intermediaries (agency, employment business and other labour workforce suppliers).
* Manage the end-to-end assessment process using the IR35 Management System, KPMG OPM tool for each PSC engagement;
o Provide technical advice and guidance to the hiring manager in support of the assessment process.
o Develop an in-depth understanding of the working practices and contractual arrangements and reflect appropriately within the assessment record.
o Obtain and document a contract of engagement and scope of work for each PSC. Where no contract of engagement is available, work with the hiring manager and supply chain team to issue appropriate terms.
o Generate an SDS for each company to confirm employment status and communicate the outcome to the relevant hiring manager, contractor and intermediary, in a timely manner.
o Where Off Payroll Working rules apply, communicate promptly to the Group Central Resourcing function, to identify other routes of engagement available and/or to enlist their support in backfilling any resource shortfalls.
o As required, operate the IR35 appeals process, convening panels, collating information and evidence and recording and notifying relevant parties of the result, so they are closed out in accordance with the requirements of the legislation.
* Lead the assessment process for Sole Trader engagement models, using the HMRC CEST tool, working closely with the relevant business stakeholders to gain an in-depth understanding of the working practices and contractual arrangements.
* In accordance with the Off Payroll Working Policy, provide detailed analysis and recommendation of each model which takes into consideration the factors set out in HMRC’s Employment Status Manuals, to gain approval from the Group Chief People Officer.
* Conduct a thorough analysis of subcontract and outsourced services arrangements to ensure they align to HMRC legislation and Group Policy, as truly contracted out services. Where necessary, provide guidance to the business to support identifying the correct engagement model and assessment processes which should be followed.
* Carry out a review of labour subcontract arrangements, to understand the contractual arrangements in place and ensure processes are adopted in line with Group Policy.
* Establish reporting capabilities that include related risk exposure of each engagement model and report progress of all corresponding actions to the TA Lead and Employment Tax Manager on a weekly basis.
* Engage with key stakeholders including the Operations, Commercial, Finance and HR functions to provide subject matter expertise on Off Payroll Working and successfully embed the Group Policy, ensuring processes are understood and followed across the wider teams.
* With the support of the Group Central Resourcing function, coordinate and deliver training to all relevant stakeholders and maintain a record of attendance.
Qualifications:
* Previous experience gained within a contract management, supply chain, procurement or compliance focused role, with an understanding of supply chain and contract issuance processes.
* Understanding of IR35 and HMRC legislation relating to self-employment and contracted out services.
* Ideally, you will have significant experience of IR35 management in a large, complex organisation, within the infrastructure or construction sector.
* Effective communication skills and the ability to communicate and influence stakeholders at all levels.
* Confident working independently and able to create a structured plan that aligns to key deadlines and business objectives.
* Results driven and can work effectively in a changing landscape, prioritising conflicting and varied objectives.
* Strong analytical and reporting capabilities, with good Excel skills and ability to document complex information in a clear and concise manner.
* Proven level of dispute resolution and change management skill sets.
